June 2021 FOI Investigators Conference Terms & Conditions
These are the Terms & Conditions that will apply to you as an “Attendee” and participant in the June 24-27, 2021 Fraternal Order of Investigators’ event in Kerrville, Texas (the “Conference”) and Pallorium, Inc. (Pallorium) d.b.a the Fraternal Order of Investigators (FOI) the (“Producers”) and Steven Rambam. By purchasing a ticket or registering for this conference, you as the Attendee agrees to comply with and be bound by all of the following Terms. If you are registering on behalf of another it is your responsibility to ensure that the person attending is aware of the following terms and accepts them, and by completing the registration you are warranting that you have made the attendee aware of these terms and that they have accepted all of these terms without exception.
Event Admission: Your Conference registration entitles you admittance to the conference event for which you have specifically registered. Any and all other costs associated with your Conference attendance (including without limitation any travel and/or accommodation expenses) shall be borne solely by you and the Conference Producers and Organizers shall have no liability for such costs.
Attendee Badge Usage: Attendee badges must be worn at all times in Conference areas. Security will not permit access to anyone without a Conference badge. Attendees wearing falsified badges and/or sharing or swapping badges will be immediately ejected from the Conference and there will be no refunds issued. The Conference Producers and Organizers consider such conduct theft of service, trespassing, and fraud and may report violators to law enforcement authorities. If such conduct is discovered after the Conference, violators will be invoiced according to onsite registration pricing and will be required to pay their invoice in full.
Personal Conduct: All Conference attendees are expected to comport themselves in a professional and fraternal manner at all times. Disruptive or unprofessional conduct will result in revocation of Conference credentials and ejection from the Conference.
Soliciting of Attendees/Suitcasing: “Suitcasing” refers to the practice of attending a trade show but “working the aisles” from a suitcase or briefcase, soliciting business from other attendees and exhibitors. For the good of the show and the exhibitors supporting the Conference, the only legitimate place to conduct business during show hours is within a contracted exhibitor space on the vendor floor. Exhibiting companies are encouraged to protect their investment and report any violations to Conference Producers and Organizers. Attendees observed soliciting business in the aisles or other public spaces, or in another vendor’s booth, will be ejected from the Conference.
Event Content: You acknowledge and agree that conference producers and organizers, in their sole discretion, reserve the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, and time.
Intellectual property: All intellectual property rights in and to this conference, the conference content and all materials distributed at or in connection with this conference are owned by the conference producers and organizers and/or the conference sponsors or speakers presenting at the conference. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at this conference, in any conference content and/or in any materials distributed at or in connection with the conference for any reason without the prior written permission of the conference producers and/or organizers. AUDIO and/or VIDEO RECORDING OF PRESENTATIONS and/or PRESENTERS WITHOUT WRITTEN PREMISSION SIGNED BY AN OFFICER OF PALLORIUM, INC. IS STRICTLY PROHIBITED.
Payments: All registrations made prior to the conference must be paid in full to guarantee registration.
Early Bird Rate: In order to qualify for any “early bird” rates or discounts, booking and payment must be received before the deadline date of 04 June 2021 at 11:59pm Central Time.
Cancellation & Refund Policy: Our cancellation policy allows for a full refund for cancellations received in writing prior to May 21, 2021. Cancellations received in writing between 21 May 2021 and 04 June 2021 will receive a 50% discount. There will be no refunds after 04 June 2021. However, a paid registrant can appoint a designee to take his/her paid ticket until 17 June 2021. No refunds to anyone leaving the conference early under any circumstances. If a registered attendee does not cancel in writing and/or fails to attend the conference, this will be treated as a conference cancellation and no refund or credit will be issued. If you must cancel a registration, please submit your request in writing to FOI@fraternalinvestigators.org
Adjustment of Registration Fees: After the registration is completed, the producers and/or organizers reserve the right to review the information provided by the registrant and adjust the registration ticket type and fee if it is found that the information provided by the attendee has been misrepresented, false or incorrect. Any adjustment to fees will be charged directly to the payment method on file.
NOTE – We do not issue invoices for individual conference registrations.
Speakers: Views expressed by speakers are their own. The event producers and organizers cannot accept liability for advice given, or views expressed, by any speaker at the conference or in any material provided to attendees. The producers and organizers may use the speaker’s name and presentation materials for promoting attendance at the conference. Presentations and papers including all associated artwork and illustrations will not be returned unless specifically requested by the author. The producers and organizers may audio and/or video tape the speaker’s session and the recording may be reproduced and sold as part of the overall conference materials. The producers and organizers may reproduce copies of the speaker’s presentation (eg. PowerPoint slides or supporting handouts) on paper and/or electronically and these may be sold as part of the overall hand-out materials during the conference and after the event. Any acknowledgement regarding Copyright or support should be included at the end of the abstract/presentation, as these will be distributed to the conference delegates. Speakers who do not wish to give permission for the above terms and conditions should contact the events team before the commencement of the conference. AUDIO and/or VIDEO RECORDING OF PRESENTATIONS and/or PRESENTERS WITHOUT WRITTEN PREMISSION SIGNED BY AN OFFICER OF PALLORIUM, INC. IS STRICTLY PROHIBITED.
Promotions: From time to time the producers and/or organizers will issue limited-availability discount and incentive promotions. Such promotions only apply to qualifying individuals for qualifying products, and only one discount or promotion may be applied per purchase. Discounts may neither be applied retroactively to prior purchases nor extended beyond the expiration date.
Data Protection: By submitting registration details, delegates agree to allow the producers and organizers to contact them regarding their services. Attendees who do not wish to receive such communications need to contact the events team within 48 hours of event registration.
Websites & Links: The conference and associated event websites may link to other websites and networking tools provided for the convenience of the users. The contents of these websites are maintained by their owners, for which the producers and organizers take no responsibility. Neither can responsibility be taken for contents of any website linking to this website.
Insurance: It is the responsibility and option of the attendee to arrange any appropriate insurance coverage they may personally desire in connection with their attendance at the conference. The producers and organizers cannot be held liable for any loss, liability or damage to personal property or attendees associated with this event.
Photographs, Publicity Material, Radio and Television and Print Media: The producers and organizers reserve the sole right to use any photographs, recordings, electronic images or publicity material received by or obtained by the producers and organizers in the course of this event, for whatever use deemed proper by the producers and/or organizers and the producers and/or organizers have the exclusive right to include photographic, video and other visual portrayals of Attendees, Sponsors, Exhibitors and their Exhibits including its contents, in any pictorial medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity and otherwise, without compensation to the Attendee, Sponsor or Exhibitor, and all rights titled and interest bearing (including all worldwide copyrights therein) will be the producers and/or organizers sole property, free of any claims of Attendee, Exhibitor or Sponsor or any persons deriving any rights or interest from the Attendee, Exhibitor or Sponsor.
Hotel, Meetings and Hospitality Functions: Attendee agrees that it will not, nor will its employees or representatives conduct any type of function in the Facility or any participating hotel’s meeting rooms, public areas, hospitality suites or suites during event hours without the prior written consent of the producers and/or organizers.
Visa Requirements / Invitation Letter: It is the attendee’s sole responsibility to take care of visa requirements. If you require an entry visa, you must allow sufficient time for the visa application procedure. Your registration details might be shared with the immigration authorities to assist in the immigration process. However, the producers and/or organizers will not contact embassies and consulates on your behalf. To receive an invitation letter for the Conference, you must first register and pay the registration fees in full. Credentials: The issued conference credentials are the sole property of the Conference Organizers and must be surrendered upon demand to the producers and/or organizers representatives. The event issued credentials must be prominently displayed while at the conference or designated off-site activities. False certification of an individual as an attendee or exhibitor’s representative, misuse of an attendee badge, or any other method or device used to assist unauthorized personnel to gain admittance to the conference and/or exhibit floor, will be just cause for expelling the attendee and his representative(s) from the conference and/or banning them from future entrance into the conference. This would also warrant the removal of the exhibitor’s booth from the floor without obligation on the part of the producers and/or organizers for refund of any fees. The attendee, exhibitor, his/her employees and agents, and anyone claiming to be in the conference through the attendee, waives any rights or claims for damages arising out of the enforcement of this rule.
Admittance: In its sole discretion and without refund, the producers and/or organizers reserve the right to refuse admittance to or expel from the conference anyone that it determines is behaving in a manner that could be disruptive to the conference or any other attendee.
Loss of a ticket. The producers and/or organizers will not responsible for any conference badges that are lost or stolen. Any attempt to deceive the producers and/or organizers will result in the removal of all parties involved.
Disclaimer: The producers and/or organizers may at any time, with or without giving notice, in its absolute discretion and without giving any reason, change, cancel or postpone the conference, change its venue or any of the other published particulars, or withdraw any invitation to attend. In any case, neither the producers and/or organizers nor any of its officers, employees, agents, members or representatives shall be liable for any loss, liability, damage or expense suffered or incurred by any person, nor will they return any money paid to them in connection with the conference unless they are satisfied not only that the money in question remains under their control, but also that the person who paid it has been unfairly prejudiced, about which the decision shall be in their sole and unfettered discretion and, when announced, final and conclusive.
Liability: By participating in this Conference, Attendees agree that the Conference Producers and Organizers will have no liability whatsoever for, and shall be held harmless by Attendees against, any liability for any injuries, losses or damages of any kind to persons, including personal injury or death, or property resulting in whole or in part, directly or indirectly, from participation in this Conference or any other Conference-related activity, from acceptance, possession, misuse, or use of any prize or entry, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. Attendees agree that the Conference Producers and Organizers will not be responsible or liable for any injuries, damages, or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages arising out of access to and use of website picon2021.com and related websites or any other website operated by the Conference Producers and Organizers or its affiliates, or from downloading from and/or printing material downloaded from said websites. Without limiting the foregoing, everything regarding the Conference, including the website and all prizes, are provided AS IS without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The Attendee understands and agrees that the Attendee must reimburse Pallorium, Inc. and/or Steven Rambam for any and all legal fees which Pallorium, Inc. and/or Steven Rambam may be required to pay should Pallorium, Inc. and/or Steven Rambam need to retain legal representation to protect their rights and interests in connection with any situation of any kind arising from this Agreement or Attendees’ participation in the Conference. Attendee understands and agrees that all expenses incurred by Pallorium, Inc. and/or Steven Rambam must be reimbursed by Attendee within one (1) week of their written request.
Public Health Issues: Our primary concern is the health and safety of our members and that concern will guide all of FOI’s future activities until COVID has been eliminated as a concern. Reckless conduct regarding health and safety issues will result in revocation of Conference credentials and ejection from the Conference. Conference attendees are solely responsible for their own health and safety. Neither Pallorium, Inc / the Fraternal Order of Investigators nor any affiliated persons or entities make any representations or guarantees regarding the ongoing health or safety of any person attending any FOI event. Although the current public health situation continues to improve, it is still prudent to maintain appropriate social distancing and other precautions. Therefore, precautionary seating and food service arrangements will be provided and should be observed.
The Attendee is fully responsible for all damages, losses, costs and expenses, including legal fees, suffered by the Conference Producers and Organizers as a result of any action by the Attendee or by any breach of these Terms. The maximum aggregate liability of the Conference Producers and Organizers for any claim in any way connected with the conference or the Terms & Conditions of this agreement, whether in contract, tort or otherwise (including any negligent act or omission) shall be limited to the amount paid by you to the Conference Producers and Organizers under this Agreement to attend the conference. The Conference Producers and Organizers and its partners will not be liable for: cancellation, substitution or rescheduling of the Conference which occurs due to a fortuitous event, force majeure, or any other circumstance which renders the holding of the Conference illegal, impossible or materially impracticable, and which was not foreseeable to the producers and/or organizers at the time of planning, announcing and opening registration for the Conference; any loss, injury or damage to any person or property howsoever caused at or in connection with the Conference, save for the type of liability that cannot by be excluded or limited under the applicable law; inaccuracy or incompleteness of information on the website of the Conference, specifically www.fraternalinvestigators.org and/or any related websites.
Conference Website: The website www.fraternalinvestigators.org and/or any related websites and the Conference are provided on an “as is” and “as available” basis for the personal use of the Attendees without any representations by the producers and/or organizers. Unless specified in separate terms and conditions relating to a particular product or service, the producers and/or organizers do not make any warranties, whether express or implied, in relation to the websites, or products or services offered on the websites whether by the producers and/or organizers, its partners, or on behalf of by the producers and/or organizers. The producers and/or organizers have the right to make changes to the website as they may deem necessary and cannot guarantee and shall not be responsible for any inaccuracies, schedule changes, speaker changes, or any errors which may appear on the website.
Force Majeure: The producers and/or organizers shall not be held responsible for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, strike, civil, governmental or military authority, acts of God, acts of terrorism, acts of war, epidemics, the availability of the Venue or other similar causes beyond its reasonable control and without the fault or negligence of the producers and/or organizers or its subcontractors. For one or more of such reasons, the producers and/or organizers may postpone, reschedule or cancel the event without liability on the part of the producers and/or organizers. In the event the conference cannot be held or is postponed pursuant to this section, the producers and/or organizers shall not be liable to attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses. The producers and/or organizers will review refund and/or fee transfer requests, submitted in writing, for approval on a situational basis.
Jurisdiction: This Agreement shall be governed by the laws of the State of Texas and the parties shall submit to the exclusive jurisdiction of the Kerr County courts. With the exception of individual agreements between the parties, no other terms and conditions besides these Terms shall apply to the relationship between Pallorium, Inc. and the Attendee in connection with an Event or purchase or registration of a ticket. These Terms contain the entire agreement and understanding between the parties in respect of all matters which are referred to herein and supersede any prior, written or oral agreement relating to such matters. If any part of the Terms turns out to be unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable and shall not affect the validity and enforceability of any of the remaining provisions of the Terms.
Communications: By providing us with your contact information you agree to receive communications from the Fraternal Order of Investigators, directly or via Pallorium, Inc. You may opt out of receiving communications at any time by notifying us at FOI@fraternalinvestigators.org
Should any term and/or condition and/or portion of this agreement be declared illegal or otherwise unenforceable, it shall be severed from the remainder of this agreement without affecting the legality or enforceability of the remaining terms and/or conditions and/or portions.
